mso-bidi-font-family:Tahoma;mso-ansi-language:EN-GB">On 6<sup>th</sup> November 2019, counsel for the applicant (hereinafter called the applicant) filed a motion on notice to set aside the writ of possession granted in favour of the plaintiff/respondent (hereinafter called the respondent) on 29<sup>th</sup> March 2019. The motion is supported by affidavit and annexures. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma;mso-ansi-language:EN-GB">The relevant paragraphs of the affidavit in support to this ruling are as follows:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma;mso-ansi-language: EN-GB">2. That on the 20<sup>th</sup> day of March 2019, the respondent herein applied for writ of possession in respect of store number 12 located on the grounds of St. Joseph Roman Catholic Junior High School Suame, Kumasi.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma;mso-ansi-language: EN-GB">4. That on the motion paper, the respondent herein (then applicant) sought leave to issue writ of possession against Nana Bonsu, Gabbat Co. Ltd and Andrews Afriyie respectively.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:35.45pt;text-align:justify;text-indent: -35.45pt;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma;mso-ansi-language: EN-GB">5. That in the supporting affidavit, the respondent herein at paragraph 6 thereof deposed to the fact that, those in occupation/possession of store number 12 were Nana Bonsu, Gabbat Co. Ltd and Andrews Afriyie.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma;mso-ansi-language: EN-GB">6. That I wish to state that, the respondent herein fraudulently misrepresented to the court that, the defendants were rather in possession when the respondent herein knew factually that, I was in possession of store number 12 long before the year 2000 as the lawful owner thereof.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma;mso-ansi-language: EN-GB">7. That I am legally advised and verily believed the same to be true that, the respondent should have given me notice as mandatorily required under order 43 rule 3 (3) of C I 47 but for the fraudulent misrepresentation of that crucial material fact that, the defendants in the main case were in possession.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma;mso-ansi-language: EN-GB">8. That I am advised and verily believe same to be true that, the order <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-bidi-font-family:Tahoma;mso-ansi-language:EN-GB">granted by this honourable court dated 29<sup>th</sup> day of March 2019 in copy of which is attached and marked as exhibit IGIT 2 has occasioned miscarriage of justice as to me as same constitutes a breach of rule of natural justice to me equally.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma;mso-ansi-language: EN-GB">9. That I am further legally advised and verily believe the same to be true that, the said order dated the 29<sup>th</sup> day March 2019 was null and void as same was obtained in gross defiance of order 43 rule 3 (3) of CI 47.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:35.45pt;text-align:justi
