The defendants assert that the plaintiff divested his interest in the land in dispute in 2007 to one Joseph Assirado and the said transfer was confirmed by a statutory declaration dated 22<sup>nd</sup> March 2007 (exhibit KTD 1). As part of the transfer, the plaintiff surrendered his original land title certificate (exhibit KTD 2) to the said Joseph Assirado for the purpose of effecting the transfer at the Lands Commission.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The defendants assert that Mr. Joseph Assirado went ahead to register his interest at the Lands Commission and was issued with a land title certificate on 21<sup>st</sup> February 2020 (exhibit KTD 3). The defendants assert that the true owner of the land is Joseph Assirado and the 1<sup>st</sup> defendant has been acting pursuant to the instructions of the said Joseph Assirado. He stated that he sold a different parcel of land to the said Joseph Assirado through the 1<sup>st</sup> defendant who was acting as Joseph Assirado’s agent. He however admitted executing the statutory declaration (exhibit KTD 1) but stated that the said exhibit does not relate to the land in dispute.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">He further admitted giving his original land title certificate to the 1<sup>st</sup> defendant during the transaction but he stated that it was inadvertent on his part and subsequent demands for the 1<sup>st</sup> defendant to return the said land title certificate were not heeded to as the 1<sup>st</sup> defendant avoided meeting him.
