The Defendants who are tenants of the Plaintiff residing in the property situate at Bannerman Road, the subject matter of the suit herein, had their tenancies expiring respectively in 2006. At that time, several notices were served on them to give up possession, however, they failed or refused to do same despite the leeway given them by the Plaintiff in a bid to get them to vacate, which includes a grace period of six (6) months to enable them pay their arrears between 2006 and 2012 and also to look for alternative accommodation. However, none of the Defendants complied with the notices. As a result, Plaintiff instituted an action against them in suit number AC 132/2013 but proceedings were halted for parties to attempt out of court settlement. Once attempts at settlement failed, Plaintiff returned to have the case relisted but this could not be done for a number of reasons. There is further proof that the witness statement of Plaintiff’s witness as well as the hearing notice for the adjourned date were also served on the Defendants by same means on April 30, 2019. Nonetheless, the Defendants failed or neglected to enter appearance or put in a defence within the time limited by the rules. Thus on November 19, 2019, this court awarded interlocutory judgment in favour of the Plaintiff for reliefs (a) and (b) as endorsed on the writ of summons and reserved the issue of cost to be addressed at the time the Plaintiff obtains final judgment. The case was then adjourned finally to May 21, 2020 for Plaintiff to present evidence in proof of its claim for final judgment. Indeed, there is proof on record that the Defendants were ser
