He grounds his application on reasons set out in his affidavit in support, which he deposed to personally. The main ground on which he basis his application is that the instant action arises from a tenancy agreement signed between the Plaintiff and the 1<sup>st</sup> Defendant, a limited liability company incorporated in Ghana and no specific allegations of liability having been raised against him in his personal capacity, he is not a proper or necessary party to the suit.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The Respondent is opposed to the application as observed from the averments contained in the affidavit in opposition to the application deposed to on its behalf by its Managing Director, one Franklyn Agyemang. From my understanding of the averments contained in this affidavit in opposition, it is the claim of the Respondent that it rented out its premises, a warehouse, to the 1<sup>st</sup> Defendant, whose directors, including the 2<sup>nd</sup> Defendant/Applicant are all foreign nationals of Chinese origin. Subsequently, a fire outbreak gutted down the warehouse and rather than cooperate with the Respondent to resolve issues arising from this fire incidence, the 2<sup>nd</sup> Defendant/Applicant and the other directors of the 1<sup>st</sup> Defendant Company have gone into hiding and refuse to cooperate with the Respondent, evincing a clear intention to evade justice and accountability, culminating in the issuance of the present writ of summons against them. The Respondent further asserts that in the interest of justice and to ensure that all matters in controversy are effectively and completely determined, the application to misjoin the 2<sup>nd</sup> Defendant should be dismissed.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif">It may be prudent to pause here and state that the Respondent claims against the Defendants, jointly and severally, the following reliefs as endorsed on its writ of summons and the accompanying statement of claim:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0cm;margin-right:36.0pt;margin-bottom: 0cm;margin-left:63.0pt;margin-bottom:.0001pt;text-align:justify;text-indent: -27.0pt;line-height:115%"><i><span style="font-size:12.0pt;line-height:115%;font-family:&q
