On 21<sup>st</sup> August, 2019 upon an application filed by the Defendants/Respondents herein, the default judgment was set aside. The court also set aside the subsequent processes flowing from the default judgment. These processes included the execution process which attached the Articulator Trucks belonging to the 2<sup>nd</sup> Defendant/2<sup>nd</sup> Respondent herein.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">On 18<sup>th</sup> September, 2019, the Applicants herein applied for an order for stay of execution in respect of the release of the two Articulator Trucks but the same was refused by the court. There has been several legal wrangling in respect of this case. This include an application for preservation of the said articulator trucks – which was refused by the court and an ex-parte motion for the release of the said trucks – which was granted by the court. The said ex-parte motion was granted by the court on 5<sup>th</sup> September, 2019. Also on October 18, 2019 the court granted an application to set aside the writ and statement of claim.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">In the instant application, the applicants are praying this Court for an order of stay of execution of the release of the Articulator Trucks pending appeal against the October 18<sup>th</sup> order.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The gravamen of the applicant’s case is that the ruling releasing the vehicles to the Respondents is an executable order. That, the 2<sup>nd</sup> and 3<sup>rd</sup> Defendants/Respondents are Burkinabe Nationals whose whereabouts is difficult to ascertain except through co
