At the time of his dismissal, the Appellant was a Jack Hammer Operator. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><b><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">[2] </span></b><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman";mso-bidi-font-weight:bold">The Appellant’s case is that on 31<sup>st</sup> June 2008, he and two other employees of the Respondent who were Blastsmen, went underground to work at Level 23 No 1354 cross-court. The two Blastsmen were Yahaya and Seidu Adams. He averred that after they had finished drilling, Yahaya, left him and Seidu Adams. He was then instructed by Seidu Adams to go round and tell all those working in the area that they were going to blast at 3:00pm. He complied with the instructions and upon his return, Seidu Adams told him that he had already lit the dynamite. The Appellant said as a result, he left his bag behind which contained, a Rescuer, a water bottle and connection rubbers. He said Seidu Adams told him that he could retrieve the bag only after the blasting has been done. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><b><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">[3] </span></b><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman";mso-bidi-font-weight:bold">The following day, before he could go for his bag, he was asked to see those in charge of security. When he went, the Security told him that he was suspected of attempting to steal some gold. He was paraded together with others and was identified by one of the Managers of AngloGold Ashanti (AGA) called Fred as one of the thieves who pushed the Captain down and fled in the stealing incident. The Captain however said he was not the one who pushed him down and that he could identify the one. He was later reported to the Respondent by the Manager of AGA.
