K. Numekevor was recruited by the Police Service in December 1989. He served as a police officer for over twenty years and became a Sergeant in the Ghana Police Service. Due to sequence of events that started in about February 2009, when he was stationed at Kwahu Praso in the Eastern Region, General Sergeant Numekevor’s employment was terminated by the Ghana Police Service. General Sergeant Numekevor alleges that his termination/dismissal was unlawful because his right to be heard was violated and therefore, prays for an order of reinstatement and for the payment of all his salary arrears from 2009 till date of reinstatement. The position of the Defendants, in particular the 1st Defendant is that the Plaintiff absented himself from duty from January 21, 2009 and only resurfaced at his duty post in or around June 2009. The Defendants contend that the Plaintiff was charged with misconduct and was offered the opportunity to defend himself but he did not avail himself. Background Facts:<o:p></o:p></span></b></p><p class="yiv1333136668msonormal" style="margin: 0cm 0cm 0.0001pt; text-align: justify; line-height: 150%; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><b><span style="font-family: "Book Antiqua", serif;">[<a name="par2">2</a>]</span></b><span style="font-family: "Book Antiqua", serif;"> </span><span style="font-family: "Book Antiqua", serif;">The sequence of events giving rise to this matter, according to the Plaintiff, commenced in February 2009 when he was stationed at Kwahu Praso, where his Station Officer, one Inspector Daniel Kwayisi Kwapong, detailed him to report at Sempowa, also in the Eastern Region for duty. <a name="_Hlk88012905">According to the Plaintiff, </a></span><span style="font-family: "Book Antiqua",serif;color:#1D2228">he sought permission to travel because his mother had died but the request was denied him as no signal of the death was received by the police service. </span><a name="_Hlk88013297"></a><span style="font-family: "Book Antiqua", serif;">According to him, the duty to Sempowa was rescheduled to June 2009 and </span><span style="font-family: "Book Antiqua", serif;">he undertook the duty from June 2009 to September 2009. It is the case of the Plaintiff that he was the Sergeant in charge at Sempowa village and served with two officers, Lance Corporal Christopher Agbolosoo and Constable Emmanuel Gyasi at Sempowa. <o:p></o:p></span></p><p class="decisions" style="margin:0cm;margin-bottom:.0001pt;text-align:justify; line-height:150%"><span style="font-family: "Book Antiqua", serif;"> </span></p><p class="decisions" style="margin:0cm;margin-bottom:.0001pt;text-align:justify; line-height:150%"><b><span style="font-family: "Book Antiqua", serif;">[3]</span></b><span style="font-family: "Book Antiqua", serif;"> The Plaintiff further averred that at Sempowa, he made the appropriate entries in the station diary and successfully completed his tour of duty. He further averred that in September 2009, when he went to the bank to withdraw his salary, he was informed that his salary had been suspended. According to him when he reached out to his District Officer, he was informed that his Station Officer had reported that he had deserted his post. It was averred that the Plaintiff was immediately arrested and detained for four days and charged with the offence of desertion.
