The writ was accompanied by a statement of claim made up of 15 paragraphs. The land the Plaintiff so acquired is situate at Okpoi Gonno in Accra.<b><o:p></o:p></b></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">The land in dispute is a small part of a larger land which is a subject-matter of a Statutory Declaration made by Stephen Otu Okle of Nungua which vested the larger land, the subject-matter of the Statutory Declaration, in the said Stephen Otu Okle. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">The large tract of land, the subject-matter of the Statutory Declaration as aforementioned, which was/is perpetually and free from all in cumbrances was vested in Otu Okle.<o:p></o:p></span></p><p class="MsoListParagraph" style="text-align:justify;text-indent:-36.0pt; line-height:150%;mso-list:l4 level2 lfo6"><!--[if !supportLists]--><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">1.2<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> </span></span><!--[endif]--><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma">By a Deed of Conveyance dated the 9<sup>th</sup> day of April, 1994, Otu Okle aforementioned transferred the disputed land to one Gloria Adjei, the Plaintiff’s grantor, who also subsequently on the 26<sup>th</sup> day of May, 2005, by a purchase agreement, sold the disputed land to the Plaintiff for valuable consideration.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">After the purchase of the land from Gloria Adjei, the Plaintiff went into effective possession and erected corner pillars on same and deposited building materials on it with the intention of commencing a building project on the land in dispute.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><b><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">1.3 </span></b><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma"> The Plaintiff who was travelling to London, appointed a caretaker to take care of the land. The said caretaker was planting food crops and raring animals on the land but as a result of ill-health the caretaker had to leave the land whilst the Plaintiff was still out of the jurisdiction.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">Sometime ago, upon a visit by the Plaintiff to the land, she noticed that someone had trespassed onto the land in dispute and had already started building on it. With the help of the caretaker, the plaintiff later came to know that it was the defendant who had trespassed onto the land. In spite of efforts made by the Plaintiff to let the Defendant stop his trespassory conduct, the Defendant would not budge.
