text-align:center"><b><span style="font-size:12.0pt;line-height:107%;font-family:"Book Antiqua",serif"> </span></b></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">On 7<sup>th</sup> December, 2017, Plaintiff instituted the instant action against the Defendant claiming the following reliefs:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif">(i) A declaration that all that land situate at Windy Ridge in the Sekondi-Takoradi metropolitan Assembly in the Western Region of the Republic of Ghana the boundaries whereof starting from survey pillar WRF 1 which pillar is 4033.5ft on a bearing of 323°00’ from survey of Ghana pillar marked SGW F1 15 2 which bearing together with all other bearings hereinafter mentioned is referred to Meridian 1° west Longitude thence runs on a bearing of 019°58’ for a distance of 252.7ft to pillar marked WRF 2, thence runs from on a bearing of 099°14’ for a distance of 194.6ft to pillar marked WRF 3, thence runs on a bearing of 190°29’ for a distance of 218.4ft to pillar marked WRF 4, thence runs on a bearing of 272°03’ for a distance of 238.7ft to pillar marked WRF 1 the point of commencement and thereby enclosing an approximate area of 1.15 of an Acre with the house of the plaintiff thereon belongs to the plaintiff.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif">(ii) An order of perpetual injunction against the defendant, her agents, assigns and all persons deriving title from her to desist from interfering with the plaintiff’s quiet enjoyment of the said land in any manner whatsoever.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif">(iii) Punitive damages for trespass and trauma caused by the breaking of the party wall constructed by the plaintiff.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif">(iv) An order directed at the defendant to properly reconstruct the party wall to the same state it was before her unlawful act.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; Defendant’s claim that the party wall erected by the Plaintiff has encroached unto her land led to this action. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">From the pleadings, the Plaintiff is saying that he was granted a lease from the Government of Ghana in October, 1969. Plaintiff further contends that he went into possession and erected his residential premises and moved into same in March 1977.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">It is the Plaintiff’s case that he moved into his residence thirteen (13) clear years before the Defendant acquired her land and had been in undisturbed possession of the land including the disputed portion until 2017 when Defenda
