The applicant contends that the respondent entered into a contract of bailment with him in respect of a Lucas Mill Machine which agreement was executed on 20<sup>th</sup> September 2016 as per Exhibit A. Per the agreement, the respondent ceded possession of the machine to him to be installed on his land at Pabi, Asamankese. That during the pendency of the agreement one Akwasi Obeng Agyeman revealed to him that he is the owner of the machine and had earlier entered into a hire agreement with the respondent whereby the respondent agreed with him to retain possession of the machine in consideration of paying an amount of Ghc6,000.00 per month into the owner’s designated account. That the respondent had been irregular with the payment and so he terminated the agreement as per a letter dated 18<sup>th</sup> April 2017, <b>Exhibit B</b>. Upon the termination of the agreement between the respondent and the owner, the owner then entered into a direct bailment agreement with the applicant with respect to the machine as per <b>Exhibit C</b>.
