That we the Plaintiffs/Applicants on the same 28<sup>th</sup> day of January 2020 also filed a motion on notice for interlocutory injunction and duly served all the processes on the Defendant/Respondent and the Defendant/Respondent duly entered conditional appearance per his lawyer on 28<sup>th</sup> day of February 2020 accordingly. Attached is s copy of the proof of service as exhibit ‘A’.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0cm;text-align:justify;text-indent: -1.0cm"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-ansi-language:EN-GB">6. That while the Plaintiffs/Applicants motion on notice for interlocutory injunction seeking to restrain the Defendant/Respondent from holding himself out as Chairman of the Kumasi Club Limited, whether present or past and in any other forum in the Ashanti Region or any part of the Republic of Ghana and outside Ghana in the name of the Kumasi Club Limited was pending, the Respondent/Contemnor has deliberately and wilfully ignored the pending proceedings or action.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:21.3pt;text-align:justify;text-indent: -21.3pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-ansi-language:EN-GB">8. And the Applicants repeating the preceding paragraph relevant that by such wanton misconduct and disrespect to the administration of justice, the Respondent for instance filed an action and blatantly described himself as the Chairman of the Management Committee of the Kumasi Club Limited. (herein referred to as the Club) Attached is exhibit ‘B’ as proof.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:14.2pt;text-align:justify;text-indent: -14.2pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-ansi-language:EN-GB">9. That while the matter is pending in court, the Respondent/Contemnor is not only holding himself out but still acts as the Chairman of the Kumasi Club Limited in words and action, at gathering whereby describing himself as the Chairman in spite of the injunction but also facilitated, instigated, engineered publication especially through <b>Ghana Web</b> showing pictures of some of the Executives and some of the plaintiffs in that pending action seeking to restrain the Respondent from acting and holding himself out in the name of the Kumasi Club Limited. Attached are copies of the publication as exhibit ‘C’ series. That we shall tender in evidence videos and audios whereby the Respondent keeps holding himself out as the Chairman of the Kumasi Club Limited despite of the pendency of the restraining injunction action.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:35.45pt;text-align:justify;text-indent: -35.45pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-ansi-language:EN-GB">11. That the act/conduct of the Respondent by disrespecting the pending action is wilful and disrespect to the administration of justice.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:35.45pt;text-align:justify;text-indent: -35.45pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-ansi-language:EN-GB">12. That the Respondent acts/conducts sin against law and equity, purporting to overreach the court and the Plaintiffs /Applicants herein in the pending action which motion on notice for interlocutory injunction seeking to restrain him (Respondent) is still pending.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:35.45pt;text-align:justify;text-indent: -35.45pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-ansi-language:EN-GB">15. That the Respondent shall only show respect to rule of law and pending matters in court except committed for contempt of court.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:35.45pt;text-align:justify;text-indent: -35.45pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif;mso-ansi-language:EN-GB">16.
