</div>&nbsp;BRIEF FACTS<o:p></o:p>&nbsp;The Respondent is a limited liability company registered
under the laws of the Republic
engaged in the transportation business. Complainant joined the Respondent Company in 5TH February, 2014 as an Electrician of the Company. His appointment letter stated that his employment contract
was for a fixed period of 2 years subject to renewal.<o:p></o:p>On 17th May, 2016, Respondent issued
Complainant with a query. The crux of
which was for him to explain for some starters which had gone missing from the workshop.
Complainant per his letter dated 19th May, 2016, responded to the query by stating in the
main that he knew nothing about the missing
starters. Respondent per letter dated
24th May, 2016 terminated Complainant's appointment with the reason stated therein
being Complainant's inability
to account for the missing starters. Per the said letter Respondent gave Complainant 2 weeks' notice to quit. Respondent
also paid Complainant full salary for May 2016 and
an extra two weeks' salary.<o:p></o:p>On 20th July, 2016, Complainant aggrieved
with the termination of his employment commenced an action in the
Adenta District Magistrate Court for
the following reliefs: 20 months
unpaid SSNIT contributions, 4 years unpaid annual leave and
damages for wrongful termination &nbsp;(our emphasis). On 14th October,
2016, the Adenta Court upheld a preliminary objection raised against the Plaintiff's (Complainant herein) capacity to institute the action in court. The Court dismissed the writ on grounds that by
law the Attorney-General or a person authorized by him was
the proper person to sue to recover any moneys owed SSNIT.<o:p></o:p>&nbsp;&nbsp;
