mso-bidi-font-family:Tahoma">The Plaintiff, a Pharmacist, who is ordinarily domiciled in London, on 30<sup>th</sup> January, 2015 caused the present writ to issue against the Defendants seeking the reliefs indorsed on the said writ of summons.<o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:200%"><span style="font-size:12.0pt;line-height:200%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">The Plaintiff says that due to some circumstance surrounding the case including, but not limited to the loss of the court’s docket as a result of the movement of the court from the old premises to the present one, he was unable to serve the writ.<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:200%"><span style="font-size:12.0pt;line-height:200%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma">1.3 On 11<sup>th</sup> July, 2017, almost two years after the writ had been issued, upon an application by the Plaintiff, this court, albeit differently constituted granted leave for the writ to be renewed. <o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:200%"><span style="font-size:12.0pt;line-height:200%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma">1.4 On 8<sup>th</sup> November, 2017, after several attempts at effecting personal service of the writ and its accompanying statement of claim had failed, this court, (once again differently constituted), granted leave to the Plaintiff to serve the Defendants by way of substituted service.<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:200%"><span style="font-size:12.0pt;line-height:200%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma">1.5 Although the Plaintiff amended his writ and Statement of Claim on 11<sup>th</sup> July, 2017 as aforementioned, the indorsement on the Amended Writ of Summons and the original writ, were substantially the same.<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:200%"><span style="font-size:12.0pt;line-height:200%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma">1.6 The Defendants failed and or refused to enter appearance, let alone file a defence and therefore upon an application ex-parte by the Plaintiff (which was wrongfully titled as <b>“MOTION ON NOTICE”</b> on the face of the motion paper although the contents and the affidavit in support correctly showed that it was an ex-parte application), the court, once again differently constituted, entered an interlocutory judgment for the Plaintiff and against the Defendants on 21<sup>st</sup> May, 2019, and per the Rules and on the authorities, the Plaintiff was then required to lead evidence to prove his title.<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:200%"><span style="font-size:12.0pt;line-height:200%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma">1.7 On 22<sup>nd</sup> May, 2018, (a day after the interlocutory judgment had been entered for the Plaintiff and against the Defendants), one lawyer K. Agyei Gyamfi of KAG Law Consult, purporting to be acting for the 3<sup>rd</sup> Defendant herein, wrote a letter to this court asking to be furnished with the 21<sup>st</sup> May, 2019 proceedings of the court.<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:200%"><span style="font-size:12.0pt;line-height:200%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma">1.8 But that was all the court heard from the 3<sup>rd</sup> Defendant and his said lawyer.<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:36.0pt;text-align:justify;text-indent
