A declaration of title to all that piece and parcel of land situate, being and lying at Abrika Anaafo, Upper Inchaban in the Shama District of the Western Region and bounded on one side by Asamankoma family lands, on another side by Tando family lands and on the other side by the old Sekondi Cape Coast Motor Road and variously known as Abirika Anaafo lands and measuring an approximate area of 650 acres more or less.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif">2. A declaration that Defendant has no right to authorize or cause the burial of any deceased person on portions of Abirika Anaafo Lands described in paragraph 1 supra.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif">3. An order directed at Defendant to take legal steps to cause to be exhumed the remains of one Obapanyin Dorcas Eshun from the part of Abirika Anaafo Land where it was unlawfully buried. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif">4. An order of perpetual injunction restraining the Defendant, his assigns, agents, workmen, privies and all persons claiming through him from burying or permitting or authoring the burial of a deceased person on any portion of the land described in relief 1 supra without recourse to Plaintiff’s family. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">5. His testimony is best told in his own words as captured in his witness statement as follows:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><i><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">1. My name is Stephen Quayson. I live at Assorko Essaman in the Shama District of the Western Region.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><i><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">2. I am a nephew of the Plaintiff who is the Head of my Royal Pitsir Kwaata Anona family of Upper Inchaban. I am also a principal member of that family.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><i><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">3. My Royal Pitsir Kwaata Anona family of Upper Inchaban is the owner of all that piece of parcel of land situate and lying at Abirika Anaafo, Upper Inchaban in the Shama District in the Western Region of the Republic of Ghana and is bounded on one side by the Asankoma family lands, on another side by Tando family lands and on the other side by the old Sekondi-Cape Coast Motor road and covers an approximated area of 650 acres more or less and is commonly known as Abirika Anaafo Lands.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:150%"><i><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">5.
