Any other reliefs this honourable court deems fit.”<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">Applicant has deposed to a 10 paragraph affidavit in support of his application. Ebusuapanyin Kwesi Noreen Sackey and Obaahemaa Abena Konajoa II who describe themselves as Head of the Asumankoma Royal Family of Benso Wassa and Queen Mother of the Wassa Fiase Traditional Area respectively have also filed an affidavit in support of Applicant’s application. The basis for this application is that as the successor Omanhene and customary successor of the deceased Plaintiff, Applicant is clothed with the capacity to substitute the deceased. It is applicant’s case that his predecessor caused the writ of summons to be issued essentially to set aside an order of mandamus obtained by fraud. That the cause of action survives the Plaintiff.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">At the instance of the court, Applicant notified the Respondents of this application.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">Respondents are opposed to the application. In the various affidavits in opposition Respondents have demonstrated the basis of their opposition. The mainstay of their opposition is that the action was personal to the deceased Plaintiff and that the action does not survive subsequent to the death of the Plaintiff. Applicant’s said enstoolment as the Omanhene of Wassa Fiase Traditional Area to succeed the Plaintiff has also been challenged by the Respondents. 1<sup>st</sup> Respondent is claimi
