A declaration that the Plaintiffs are the owners of the entire Plot No.1 land, situate at West Fijai.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">ii. A perpetual injunction against the Defendants, their successors, assigns and their heirs restraining them from further dealing with any portion of Plot No.1, West Fijai, the Property of the Plaintiffs.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">iii. Recovery of the sum of GH¢31,690.90 [Thirty-One Thousand and Sixty-Nine Ghana Cedis Ninety Pesewas] being the total cost for the removal of debris and reconstruction of the Fence Wall.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">iv. Upon service of the Defendants Statement of Defence, the Plaintiffs on 31/10/19 filed their Reply in response to the aforesaid Statement of Defence.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">At the close of pleadings, this Court adopted the following Issues for determination:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">a. Whether or not the Plaintiffs have trespassed unto the Defendants’ land with their Fence Wall and their Water Reservoir.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">b. Whether or not the Plaintiffs are entitled to the sum of GH¢31,069.90 being the cost for destruction occasioned by the Defendants.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">c. Any other issue(s) that may arise from the fence of the Pleadings.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><b><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif">PLAINTIFF’S CASE<o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">It is the case of the Plaintiffs that, in the year 1998, they were granted a piece of land numbered Plot No. N1 situate at West Fijai for residential purpose. An indenture of lease executed in their favour and duly registered at the Lands Commission was tendered into evidence as Exhibit “A”. A building permit was also tendered as Exhibit “B”. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The case of the Plaintiffs is that as bonafide owners of Plot No. N1, West Fijai, they have the absolute right to determine its use and the structures to put thereon. That they (Plaintiffs) were the first to settle in the disputed area having acquired their Plot No. N1 from Nana Atta Komfo, Chief of Ntankoful in the year 2001. That in the bid to protect their property they erected a concrete fence wall around their building and subsequently built a water reservoir on their Land for their domestic use owing to the fact that water was very difficult to come by in the area. Plaintiffs admit that when the 3rd Defendant acquired his plot of land, he came to share boundary with theirs at one side.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The gravamen of the Plaintiffs case is that the Defendants without any justifiable basis demolished their fence wall and the water reservoir situate on their plot of land and as a result brought unto them untold hardships and exposed them to miscreants. Photos of the said destruction and estimated cost of reconstruction were tendered into evidence as Exhibits “C” and “D” respectively Plaintiffs say that the unjustifiable conduct of the Defendants has led to the instant action.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><b><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif">DEFENDANT’S CASE<o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The case of the Defendants is that in the year 2002, the 3<sup>rd</sup> Defendant was granted a piece of land that used to be a rubbish dump for his use as a residential plot. This piece of land was pillared and numbered as Plot No. N6 and it shares boundary on one side
