The said ruling is dated 23<sup>rd</sup> February, 2021.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">Awulae Angama Tu-Agyan and Nana Hima Dekyi XI, the Applicants herein are praying the court to set aside the 23<sup>rd</sup> February, 2021 orders of the Court as same is void. The application is anchored on the following grounds:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">(a) Breach of the rules of natural justice.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">(b) Want of jurisdiction.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">(c) Error of law clearly manifest on the record.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">The background facts leading to this application are that on 6<sup>th</sup> October, 2020 the Western Region House of Chiefs held elections to elect chiefs for the positions of President, Vice President and Elected Representatives to the National House of Chiefs under the supervision of the Electoral Commission of the Republic of Ghana. Three different categories of elections were therefore held on the day i.e. President of the Western Region House of Chiefs, Vice President of the Western Region House of Chiefs and Elected Representatives to the National House of Chiefs.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">Awulae Amihere Kpanyili III contested the position of President in the Presidential Category of the elections. Awulae Angama Tu-Agyan and Nana Hima Dekyi XI (Applicants herein), Awulae Annor Adjaye II, Osabarima Kwaw Entsie II and Tetrete Okuamoah Sekyim II were all duly elected as Elected Representatives to represent the Western Region at the National House of Chiefs. Awulae Angama Tu-Agyan,1st Applicant herein was in addition elected as the Vice President of the Western Region House of Chiefs. Tetrete Okuamoah Sekyim II was also elected as the President of the Western Region House of Chiefs in addition to his election as an elected representative to the National House of Chiefs.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">Awulae Amihere Kpanyili III filed a judicial review application in the nature of an order of certiorari at the High Court, Sekondi challenging the Presidential Category of the Western Region House of Chiefs elections held on 6<sup>th</sup> October, 2020.
