Introduction</span></b><span style="font-size:12.0pt;line-height:107%;font-family:"Book Antiqua",serif">:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">[1] This is a suit filed in the name of the Administrators of the Estate of Emmanuel Kwame Okanta Tetteh (deceased), as administrators, who according to the 1st Plaintiff have not taken any steps yet to distribute the estate even though the Letters of Administration (LA) was granted in 2005. The key issue raised in this suit is whether the Defendant has breached the terms of the Lease he acquired his interest in the subject matter property. It is noted that even though the suit was filed in the name of the two Plaintiffs, who are the wife and sister of the deceased, the 2nd Plaintiff testified after she was subpoenaed by the Defendant that she did not consent to be a Plaintiff in the suit. Parts of her testimony, were, in fact, contrary to the testimony of the 1st Plaintiff. The Court shall later speak to the contrary positions in this judgment. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">[2] By an Amended Writ of Summons filed on June 10, 2020, the Plaintiffs claimed against the Defendant the following judicial reliefs. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">i. An order directed at the Defendant to give the 2 shops in the property known as Parcel 13 Block No. 5 Section 2 to the Plaintiffs per the terms of the Lease dated 28th August 2002.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">ii. An order directed at the Defendant to stop superimposing the illegal structure on Plaintiffs’ property contrary to the Lease agreement and drawing plans dated 28th of August 2002.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">iii. General damages.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">iv. The Pleadings:<o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">[3] The Amended Statement of Claim that accompanied the Writ of Summons included the following pleadings at paragraphs 1 – 8, 11-13, 16 and 17.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">1. “The Plaintiffs are the surviving Administratrixes of the Estate of Emmanuel Tetteh Okantah also known as Emmanuel Tetteh who died sometime in the year 2005.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">2. The Defendant is the purported ASSIGNEE of a piece and or parcel of land situated at Dzorwulu and particularly described in the schedule thereto.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">3. That the said lease is governed by a deed of lease and dated 28th August, 2002.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">4. The Defendant is the Assignee of one Daniel Darkwa in respect of the same piece or parcel of land which said Assignment is registered as No. GA. 1962 Vol. 2 Folio 441.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">5. The Defendant is the occupier of the said premises and is currently undertaking unauthorized construction works on the land contrary to the agreed usage of the land.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">6. That the Defendant is also in the default of the payment of ground rent from 2017 which payment though due is still outstanding.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">7. Further per clause 2(ii) of the Lease Agreement dated 28th August 2002, being the Head Lease on all transactions on the land, two shops within the property should be preserved for the exclusive use of the Lessor Emmanuel Kofi Tetteh Okantah deceased.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">8. The Defendant has persistently upon request by the administratrixes refused to give the said reserved shops to the administratrixes of the Estate despite demands on him to give the said shops to the administratrixes.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:107%;font-family:"Book Antiqua",serif">11. That the Defendant is further undertaking construction works on the property which is different from the building plan and permit on which the lease agreement was premised.<o:p></o:p
