This legal battle was commenced sometime in May 2017 by the Plaintiffs against the Defendants. Since that time, the Defendants and the Plaintiffs have been engaged in this litigation which has produced a judgment and at least three applications and rulings excluding the instant two claims. The background of this case is that the three named Plaintiffs<span lang="EN-CA" style="font-family:"Book Antiqua",serif">, the Judgment Creditors, caused a Writ of Summons to be issued against the Defendants sometime in May 2017 for the recovery of sums of money and interest on the said amounts. They also sought a declaratory order by way of Relief E that “pending the full payment of all amounts and liabilities assumed by the 1st Defendant under the settlement agreements the 1st Defendant holds the 2nd Defendant as a constructive trustee for the benefit of the 1st, 2nd and/or 3rd Plaintiffs”.

<span lang="EN-CA" style="font-family:"Book Antiqua",serif">

<span lang="EN-CA" style="font-family:"Book Antiqua",serif"> [2] This court on November 20, 2017 entered judgment in favour of the Plaintiffs for the relief E endorsed on the writ of summons. In pursuit of levying execution to realize the fruits of the judgment, the Plaintiffs proceeded to attach certain landed properties described as “House Number B/189H, Grace Enclave at Madina Nkwantanang” and “12 Immovable Properties (2 Units semi-detached) residential properties situate, being and lying at Amrahia, Katamanso in the Greater Accra Region” to sell and to satisfy the judgment debt. The claims are by one Eric Adadevoh (suing per his Lawful Attorney) Prince Sarpong for the Madina Nkwantanang property. The claim for the Amrahia, Katamanso property was filed by Sylbert Systems Consult, a limited liability company. I note that prior to these claims, there had been other claims which were withdrawn. I shall later speak to/or at least comment on them. <span lang="EN" style="font-family:"Book Antiqua",serif; mso-ansi-language:EN">

<span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">
<p class="MsoNorma
