The present application is praying for an order staying execution of the alternative Judgment for an order for judicial sale of H/No.168 Kofi Dzata Street, Dzorwulu, Accra made in Suit No. RPC/176/12 pending the determination of an appeal against the Ruling of this Court dated 21<sup>st</sup> March, 2022 which Ruling dismissed the Plaintiffs action filed on 6<sup>th</sup> July, 2021.This Court dismissed the action on the grounds that same was frivolous, vexatious and abuse of Court process.</span><b><span style="font-size: 12.0pt;font-family:"Book Antiqua",serif"><o:p></o:p></span></b></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;text-justify:inter-ideograph;line-height:150%"><span style="font-size: 12.0pt;line-height:150%;font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;text-justify:inter-ideograph;line-height:150%"><span style="font-size: 12.0pt;line-height:150%;font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">The Defendant/Respondent/Respondent (hereafter called the Defendant) sued the three Plaintiffs/Appellants/Applicants (hereafter referred to as the Plaintiffs) at the High Court, Accra and obtained judgment against them. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;text-justify:inter-ideograph;line-height:150%"><span style="font-size: 12.0pt;line-height:150%;font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">The property in issue was part of the reliefs claimed by the Defendant in the alternative for judicial sale of same.
