However, in the motion paper the rule was misstated as Order 47 Rule 7. This is a mere slip which does not affect the substance of the application.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;text-indent:36.0pt;line-height:115%"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">The background facts leading to this application are that the High Court (Commercial Division) delivered judgment in favour of the Applicant on 18<sup>th</sup> March, 2019. Pursuant to the judgment, Applicant filed an Entry of Judgment against the Respondents. The Respondents failed or refused to pay the debt owed to the Applicant. Consequently, the Applicant filed a writ of <i>fifa</i> and the Deputy Sheriff attached some properties of the Respondents. The Deputy Sheriff subsequently appointed an auctioneer for the auctioning of the attached properties. Applicant participated in the public auction and purchased the attached properties as it offered the highest bid on all the properties.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;text-indent:36.0pt;line-height:115%"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">In an affidavit in support of the application, Applicant is saying that after winning the bid, there is no need for it to pay the purchase sums into court only for it to apply for same to be paid to it out of court to satisfy part of the judgment sum. That the court has the power to order it not to pay the purchase sums into court and to refund same in satisfaction of the Respondent’s judgment debt.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;text-indent:36.0pt;line-height:115%"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">In an affidavit in support of the application, the auctioneer, Joe Ala Adjetey Din who operates under the name and style Aadin Auctions deposed as follows:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0cm;margin-right:0cm;margin-bottom:0cm; margin-left:36.0pt;margin-bottom:.0001pt;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">3. That I followed the laid down rules of publication of attached properties and published the date for the auction of the attached properties.
