Respondent Company employed Complainant Justice Atta Cardigah as a staff nurse on 17<sup>th</sup> November 2011. Subsequently, on 9<sup>th</sup> June 2014, Complainant was appointed to the new position of Out-Patient Department (OPD) Manager, a position he held until 18 July<span style="letter-spacing:2.0pt"> </span>2016, when he<span style="letter-spacing:2.0pt"> </span>was summarily<span style="letter-spacing: 2.0pt"> </span>dismissed without any entitlements by Respondent. The ground for Complainant's termination was that after investigations by Respondent's Medical Executive Committee, it had been determined that Complainant had received funds meant for Respondent<span style="letter-spacing:2.0pt"> </span>into his personal account was a breach of the approved policy and procedure.<o:p></o:p></span></p> <p class="MsoBodyText" style="margin-right:1.35pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p> <p class="MsoBodyText" style="margin-right:1.35pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-font-width:105%">On that self-same day, Complainant<span style="letter-spacing: 2.0pt"> </span>per letter to the pleaded for clemency with Respondent that he had received the money in good faith without any intention to embezzle Respondent company's funds and the dismissal was commuted to termination with two months' salary in lieu of notice.<span style="letter-spacing:-.35pt"> </span>Two years afterwards, Complainant used the internal grievance to appeal the decision, and same was dismissed.<span style="letter-spacing:2.0pt"> </span>The Complainant<span style="letter-spacing:2.0pt"> </span>being dissatisfied with the state of affairs petitioned the Commission to determine a case of Unfair<span style="letter-spacing:2.0pt"> </span>Termination against the Respondent.</span><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"><o:p></o:p></span></p> <p class="MsoBodyText" style="margin-right:1.35pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-font-width:105%">The point of divergence between the parties in the instant case is that whereas Complainant claims the termination of his appointment was unfair, Respondent contends that it was lawful for it to terminate the Complainant's appointment<span style="letter-spacing:2.0pt"> </span>after following due process.</span><span style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif"><o:p></o:p></span></p> <p class="MsoBodyText" style="margin-right:1.35pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p> <p class="MsoBodyText" style="margin-right:1.35pt;text-align:justify;line-height: 115%"><b><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif"> </span></b></p> <p class="MsoBodyText" style="margin-right:1.35pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-font-width:105%">The complainant states that he was employed by Respondent as a staff nurse and subsequently OPD Manager. The complainant continued in this position<span style="letter-spacing:2.0pt"> </span>until his appointment<span style="letter-spacing:2.0pt"> </span>was terminated.<o:p></o:p></span></p> <p class="MsoBodyText" style="margin-right:1.35pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p> <p class="MsoBodyText" style="margin-right:1.35pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-font-width:110%">It<span style="letter-spacing:-1.0pt"> </span>is<span style="letter-spacing:-1.0pt"> </span>the<span style="letter-spacing:-1.0pt"> </span>Complainant's<span style="letter-spacing:-.45pt"> </span>case<span style="letter-spacing:-.8pt"> </span>that<span style="letter-spacing:-.55pt"> </span>his<span style="letter-spacing:-1.0pt"> </span>termination<span style="letter-spacing:-.3pt"> </span>was<span style="letter-spacing:-.85pt"> </span>harsh<span style="letter-spacing:-.55pt"> </span>and<span style="letter-spacing:-1.0pt"> </span>unfair<span style="letter-spacing:-.5pt"> </span>due<span style="letter-spacing:-1.0pt"> </span>to the<span style="letter-spacing:-.45pt"> </span>following reasons.<span style="letter-spacing:-1.0pt"> </span>He<span style="letter-spacing:-.45pt"> </span>was<span style="letter-spacing:-.15pt"> </span>not<span style="letter-spacing:-.25pt"> </span>cross-examined<span style="letter-spacing:-.45pt"> </span>on<span style="letter-spacing:-.5pt"> </span>the<span style="letter-spacing:-.3pt"> </span>allegations made by Madam Akasga.<span style="letter-spacing:-.75pt"> </span>This was in breach of the tenets of<span style="letter-spacing:-.05pt"> </span>natural justice.<span style="letter-spacing: -.5pt"> </span>The money<span style="letter-spacing:-.1pt"> </span>was<span style="letter-spacing:-.7pt"> </span>in<span style="letter-spacing:-.85pt"> </span>his<span style="letter-spacing:-.15pt"> </span>personal<span style="letter-spacing:-.15pt"> </span>account<span style="letter-spacing:-.1pt"> </span>for<span style="letter-spacing:-.95pt"> </span>11<span style="letter-spacing:-.7pt"> </span>days<span style="letter-spacing:-.7pt"> </span>and<span style="letter-spacing:-.7pt"> </span>not<span style="letter-spacing:-.8pt"> </span>14<span style="letter-spacing:-1.0pt"> </span>days<span style="letter-spacing:-.75pt"> </span>as<span style="letter-spacing:-.8pt"> </span>found<span style="letter-spacing:-1.0pt"> </span>by the Medical Executive Committee of the Respondent. As part of his responsibilities, he received payments on behalf of the Respondent company.<span style="letter-spacing:-1.0pt"> </span>In<span style="letter-spacing:-1.0pt"> </span>the<span style="letter-spacing:-1.0pt"> </span>instant<span style="letter-spacing:-1.0pt"> </span>case,<span style="letter-spacing:-1.0pt"> </span>he<span style="letter-spacing:-.95pt"> </span>issued<span style="letter-spacing:-.65pt"> </span>an<span style="letter-spacing:-.95pt"> </span>official<span style="letter-spacing:-.35pt"> </span>receipt<span style="letter-spacing:-.7pt"> </span>to<span style="letter-spacing:-.75pt"> </span>Madam<span style="letter-spacing:-.65pt"> </span>Akasga and<span style="letter-spacing: -.75pt"> </span>paid<span style="letter-spacing:-.2pt"> </span>it<span style="letter-spacing:-.3pt"> </span>at<span style="letter-spacing:-.2pt"> </span>the OPD.<span style="letter-spacing:-.05pt"> </span>His<span style="letter-spacing: -.2pt"> </span>WhatsApp communication with<span style="letter-spacing:-.35pt"> </span>Madam Akasga indicated that he had<span style="letter-spacing:-.4pt"> </span>no<span style="letter-spacing:-.4pt"> </span>intention<span style="letter-spacing:-.55pt"> </span>to embezzle the<span style="letter-spacing:-.5pt"> </span>Respondent company's funds.<span style="letter-spacing:-.35pt"> </span>The protocols guiding the company's operations made it impossible to embezzle funds. The complainant also says that he spent immense energy,<span style="letter-spacing: -1.0pt"> </span>used<span style="letter-spacing:-1.0pt"> </span>their<span style="letter-spacing:-.9pt"> </span>best<span style="letter-spacing:-.45pt"> </span>expertise, was<span style="letter-spacing:-.75pt"> </span>so<span style="letter-spacing: -.95pt"> </span>devoted<span style="letter-spacing:-.5pt"> </span>to<span style="letter-spacing:-.65pt"> </span>duty<span style="let
