I have read the application filed on 23<sup>rd</sup> August, 2023 by the Applicants.<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:12.0pt;margin-right:0cm;margin-bottom: 0cm;margin-left:0cm;margin-bottom:.0001pt;text-align:justify;line-height:150%; tab-stops:334.5pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-fareast-font-family:Calibri;mso-bidi-font-family: Tahoma">It is trite law, that supplementary affidavit is not filed as of right. Therefore, a party can file supplementary affidavit when leave has been granted to him to do so.<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:12.0pt;margin-right:0cm;margin-bottom: 0cm;margin-left:0cm;margin-bottom:.0001pt;text-align:justify;line-height:150%; tab-stops:334.5pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-fareast-font-family:Calibri;mso-bidi-font-family: Tahoma">However, a court will grant or refuse an application for leave to file supplementary affidavit depending on the circumstances of the case. And also, whether the applicant has been diligent in bringing his application.<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:12.0pt;margin-right:0cm;margin-bottom: 0cm;margin-left:0cm;margin-bottom:.0001pt;text-align:justify;line-height:150%; tab-stops:334.5pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-fareast-font-family:Calibri;mso-bidi-font-family: Tahoma">In this case, the Applicants failed to attach a copy of the proposed supplementary affidavit they intend to file in support of their motion to set aside the default judgment. <o:p></o:p></span></p><p class="MsoNormal" style="margin-top:12.0pt;margin-right:0cm;margin-bottom: 0cm;margin-left:0cm;margin-bottom:.0001pt;text-align:justify;line-height:150%; tab-stops:334.5pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-fareast-font-family:Calibri;mso-bidi-font-family: Tahoma">The Applicants also attached exhibits to the application but failed to attach certificate of identification under Order 20 rule 14 of C.I. 47.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%;tab-stops:334.5pt"><span lang="EN-GB" style="font-size: 12.0pt;line-height:150%;font-family:"Book Antiqua",serif;mso-fareast-font-family: Calibri;mso-bidi-font-family:Tahoma">This is a case in which judgment was delivered on 16<sup>th</sup> February, 2017. The entry of judgment was served on the Applicants by substitution as per the Order made on 10<sup>th</sup> December, 2020.
