Costs.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><b><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">Plaintiff’s Case<o:p></o:p></span></b></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;text-indent:36.0pt;line-height:115%"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">The plaintiff’s case is reflected in his statement of claim and the witness statement filed on the 16th November, 2017 and 29th July, 2019 respectively.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;text-indent:36.0pt;line-height:115%"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">The crux of Plaintiff’s claim is that he acquired 2 acres of land including the disputed land from PW1 Ebusuapanyin Kojo Mensah Arbuah of the Anona Ebusua of Shama Kumasi. According to the Plaintiff, his attempt to register the land failed as the 2-acre land had already been registered by James Neizer Ashun and siblings who were themselves members of the EBUSUAPANYIN KOJO MENSAH ARBUAH’S family. Plaintiff avers that a compromise was reached between himself, PW1 and JAMES NEIZER ASHUN and siblings wherefore JAMES NEIZER ASHUN and siblings assigned 1.19 acres of their 2.33 acres to him after the payment of valuable consideration. That the transaction between him (Plaintiff) and JAMES NEIZER ASHUN and siblings was reduced into writing in the form of an Assignment and same plotted in the records of the Lands Commission Secretariat and registered at the Deeds Registry with Deeds Registry No. 4713. According to the Plaintiff after the acquisition of the disputed land he took effective possession of same but his effort to develop the land was hampered by the Defendant who alleged that he is the owner of the disputed land.
