The Plaintiff/Appellant (hereinafter called the Plaintiff), issued out a writ against the Defendants/Respondents (hereinafter called the Defendants), jointly and severally claiming as follows:-<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-left:72.0pt;mso-add-space:auto; text-align:justify;text-indent:-36.0pt;line-height:150%"><i><span lang="EN-US" style="font-family:"Book Antiqua",serif">“(1) Recovery of the sum of US$1,765,120.86, being the outstanding balance of the indebtedness of the defendants to the plaintiff for various construction equipment and vehicles sold by plaintiff to defendants.<o:p></o:p></span></i></p><p class="MsoNormalCxSpMiddle" style="margin-left:72.0pt;mso-add-space:auto; text-align:justify;text-indent:-36.0pt;line-height:150%"><i><span lang="EN-US" style="font-family:"Book Antiqua",serif">(2) Interest on the sum of US$1,765,120.86 from 7/8/2005 to the date of final payment at the prevailing bank rate.<o:p></o:p></span></i></p><p class="MsoNormalCxSpMiddle" style="margin-left:72.0pt;mso-add-space:auto; text-align:justify;text-indent:-36.0pt;line-height:150%"><i><span lang="EN-US" style="font-family:"Book Antiqua",serif">(3) Costs, including plaintiff’s solicitor’s professional fee and filing expenses”.<o:p></o:p></span></i></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:150%"><span lang="EN-US" style="font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:150%"><span lang="EN-US" style="font-family:"Book Antiqua",serif">The writ of summons was accompanied by a Statement of claim in which the plaintiff avers that he is a businessman of Dutch nationality but resident in Dubai and brought the action through his lawful attorney Safiyan Amadu Labaran who is living in Accra. He further avers that the 1<sup>st</sup> defendant is the Managing Director of, and majority shareholder in the 2<sup>nd</sup> defendant company, a company incorporated and registered under the laws of Ghana, undertaking construction and engineering, hotels and land properties in Accra. The plaintiff alleged that between 1998 and 2000, he sold construction equipment and vehicles to the 2<sup>nd</sup> defendant through the 1<sup>st</sup> defendant and by 2004, the defendants were jointly and severally indebted to the plaintiff, in the total sum of Four Million Dutch Guilders the equivalent to one Million, eight hundred and fifteen, one hundred and twenty thousand point eighty-six United States Dollars (US$1,815,120.86). He further avers that on 18<sup>th</sup> March 2004, the 1<sup>st</sup> defendant executed a promissory note to pay the defendants’ indebtedness to the plaintiff in four periodic instalments as follows:-<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-left:72.0pt;mso-add-space:auto; text-align:justify;text-indent:-36.0pt;line-height:150%"><i><span lang="EN-US" style="font-family:"Book Antiqua",serif">“(1) A part-payment of US$31,500.00 to the plaintiff on 23/3/2004.<o:p></o:p></span></i></p><p class="Mso
